Single notification and automatic rejection
The applicant or holder of mining rights will henceforth be notified only once (without prejudice to the interested parties’ right of access to administrative information) to remedy any technical or documentary deficiencies identified during the assessment of an application for the granting, extension, transfer, suspension or other incidents relating to mining titles. Each notification shall expressly identify the irregularities and set the deadline for their rectification. . Upon expiry of that deadline without the deficiencies having been remedied or the outstanding requests for clarification having been duly addressed, the application shall be automatically rejected.
Form and means of notification
Notifications will be valid and effective when sent to the legal domicile or to the certified electronic address recorded in the mining cadastre file. In the absence of an updated legal domicile or electronic address, notifications will be deemed validly made by publication in the newspaper with the highest circulation or by posting in a public place by the authority responsible for mining licensing.
Authenticity of data and verification by the Administration
The applicant for any mining title, as well as any party involved in acts of extension, transfer, waiver, relinquishment, enlargement or modification of areas, must ensure the authenticity of the data submitted with the licensing application, without prejudice to the sanctions provided for under the Mining Law Regulations and any other applicable legislation in the event of non-compliance.
Mandatory updating of address and contact details
The applicant or holder of a mining title is now expressly required to keep the legal domicile, electronic address and telephone contacts up to date with the National Mining Institute and must proceed with their update whenever any change occurs. For notification purposes, the legal domicile, electronic address and telephone contacts provided upon submission of the application will be deemed valid. Mining title holders have a 30‑day period after the entry into force of the Decree to regularize their contact details and domicile, failing which they will be in breach under the terms of the Mining Law Regulations.
